These Terms & Conditions apply to purchases made through the MiLuxe Pantry online store (“MiLuxe Pantry”, “we”, “us” or “our”).
Please read these Terms carefully before placing an order. By placing an order through our online store, you agree to these Terms.
Nothing in these Terms affects or limits your statutory rights under UK consumer law.

2. OUR PRODUCTS
We take reasonable care to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate.
Product colours and appearance may vary slightly depending on your device, screen settings or manufacturer.
Packaging may also differ from photographs displayed on our website.
Where products are supplied or fulfilled by third-party suppliers, minor changes to packaging or presentation may occur provided that the product remains materially consistent with its description.
All products are subject to availability.
3. PLACING AN ORDER
When you place an order with MiLuxe Pantry, you are offering to purchase the selected products subject to these Terms.
You must provide complete and accurate contact, billing and delivery information.
After placing an order, you should receive an order acknowledgement or confirmation by email.
An automated acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and MiLuxe Pantry is formed when we accept your order and/or dispatch the goods.
We may refuse or cancel an order before dispatch where, for example:
• the product is unavailable;
• there is an obvious pricing or product-description error;
• payment cannot be authorised;
• we reasonably suspect fraudulent or unauthorised activity; or
• we cannot deliver to the address supplied.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
4. PRICES AND PAYMENT
Product prices are displayed in GBP (£) unless otherwise stated.
The total amount payable, including applicable delivery charges and taxes that we are required to collect, will be displayed before you complete your purchase.
We may change our prices at any time. Changes will not normally affect an order that we have already accepted.
Where an obvious pricing error has occurred, we may contact you before dispatch and give you the option of purchasing the product at the correct price or cancelling the affected item for a refund.
Payment must be made using one of the payment methods available at checkout.
Payments may be processed securely by Shopify Payments, PayPal or other payment providers made available through our checkout.
5. DROPSHIPPING AND THIRD-PARTY FULFILMENT
MiLuxe Pantry operates an online retail model that may use third-party suppliers, manufacturers, warehouses and fulfilment partners.
Some products may therefore be dispatched directly to you by a third-party supplier or fulfilment partner rather than from MiLuxe Pantry's business address.
We may use Shopify, DSers, associated suppliers, delivery companies and other service providers to process and fulfil orders.
Products contained within the same order may occasionally be dispatched separately and may arrive in different packages or on different dates.
The fact that a product is dispatched by a third-party supplier does not remove the consumer rights you have against MiLuxe Pantry as the retailer from whom you purchased the goods.
6. DELIVERY
Available delivery options and applicable charges will be displayed on our website or during checkout.
Where advertised, qualifying UK orders may receive free delivery subject to the minimum order value and any conditions displayed on our website.
Products that do not qualify for free delivery may be subject to the delivery charge displayed at checkout.
Because some products may be dispatched by third-party or overseas fulfilment partners, delivery times can vary between products.
Any delivery date or timeframe displayed on our website is an estimate unless we expressly agree a specific delivery date with you.
We will arrange delivery without undue delay and in accordance with applicable UK consumer law.
If we become aware of a significant delay, we will take reasonable steps to inform you.
You are responsible for providing a complete and accurate delivery address.
Please contact us promptly if you discover an error in your delivery details.
We cannot guarantee that an address can be changed after an order has entered fulfilment.
7. INTERNATIONAL SUPPLIERS, CUSTOMS AND TAXES
Some products sold by MiLuxe Pantry may be dispatched from suppliers located outside the United Kingdom.
Where we are legally responsible for collecting VAT or other applicable taxes, these will be handled as required by law.
We will not deliberately impose undisclosed mandatory charges after an order has been placed.
Where additional charges may lawfully apply to an order, information will be provided where required by applicable consumer law.
8. YOUR RIGHT TO CANCEL
If you are a UK consumer purchasing goods online, you will normally have the legal right to change your mind and cancel eligible purchases.
For most eligible goods, you have 14 days after receiving the goods to tell us that you wish to cancel.
You do not need to provide a reason for exercising your statutory right to cancel.

Please provide your name, order number and a clear statement that you wish to cancel the relevant order.
Certain products may be excluded from statutory cancellation rights. These can include, where applicable:
• personalised or custom-made goods;
• perishable goods;
• certain sealed products that are unsuitable for return for health protection or hygiene reasons once unsealed; and
• other products excluded under applicable law.
These exceptions do not remove your legal rights if a product is faulty, damaged or not as described.
9. RETURNS
If you exercise your statutory cancellation right after receiving eligible goods, you must return the goods within the period required by applicable UK law.
Please contact MiLuxe Pantry before sending any return.
We will provide the appropriate return instructions and return address where required.
IMPORTANT:
Do not automatically return a product to the address printed on the original parcel.
Because we use third-party fulfilment partners, the supplier's dispatch address may not be the correct returns address.
Where you simply change your mind, you may be responsible for the direct cost of returning the goods unless we have stated otherwise.
If goods are faulty, damaged, incorrectly supplied or not as described, return costs will be handled in accordance with your statutory rights.
You may inspect goods as you reasonably would in a physical shop.
Where permitted by law, we may make an appropriate deduction from a refund if goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning and their value has consequently been reduced.
10. REFUNDS
Where you are legally entitled to a refund following cancellation, we will process the refund in accordance with applicable UK consumer law.
Refunds will normally be made to the original payment method unless otherwise agreed and permitted by law.
Where legally permitted, we may wait until we receive the returned goods or evidence that the goods have been sent back before issuing the relevant refund.
Processing times after a refund has been issued may vary depending on your bank, card issuer or payment provider.
Nothing in this section limits your rights concerning faulty, damaged or misdescribed goods.
11. FAULTY, DAMAGED OR MISDESCRIBED GOODS
Goods supplied by MiLuxe Pantry must meet the requirements of applicable UK consumer law.
This includes requirements that goods are of satisfactory quality, fit for their intended purpose where applicable and as described.

• faulty;
• materially different from its description;
• incomplete; or
• develops a fault,

Photographs or video may help us investigate shipping damage or product faults more quickly, but we will not use unreasonable evidence requirements to remove your statutory rights.
Depending on the circumstances and your legal rights, an appropriate remedy may include a repair, replacement, price reduction or refund.
Nothing in these Terms excludes or restricts your statutory consumer rights.
12. CANCELLING OR CHANGING AN ORDER BEFORE DISPATCH
If you wish to cancel or change an order before it has been dispatched, please contact us as soon as possible.
Because orders may be transmitted electronically to our fulfilment partners shortly after purchase, we cannot guarantee that an order can be changed or stopped once processing has begun.
This does not affect any statutory cancellation rights you may have.
13. LOST OR UNDELIVERED ORDERS
If your order has not arrived within the expected delivery period, please contact MiLuxe Pantry so that we can investigate.
Where goods are confirmed as lost in transit or have not been delivered and you are legally entitled to a replacement or refund, we will provide the appropriate remedy in accordance with applicable law.
14. INCORRECT DELIVERY INFORMATION
Customers are responsible for checking their delivery information carefully before completing an order.
If you provide an incorrect or incomplete delivery address, contact us immediately.
We will try to correct the information before dispatch, but this may not always be possible once fulfilment has begun.
Additional costs resulting from incorrect customer-provided delivery information may be charged where lawful and reasonable.
15. PROMOTIONS, SALES AND DISCOUNT CODES
MiLuxe Pantry may occasionally offer promotional prices, sales, discount codes or other offers.
Promotions may be subject to additional conditions displayed with the relevant offer.
Unless otherwise stated, promotions:
• cannot be exchanged for cash;
• may have an expiry date;
• may be restricted to selected products; and
• may not be combined with another promotional offer.
Any comparison or promotional pricing displayed by MiLuxe Pantry is intended to comply with applicable UK consumer-protection requirements.
We may withdraw or amend a promotion where reasonably necessary, subject to existing orders and applicable consumer rights.
16. PRODUCT AVAILABILITY
All products are subject to availability.
Because stock information may be supplied by third-party fulfilment partners, stock levels can occasionally change before our systems update.
If a product becomes unavailable after you place an order, we will contact you and, where appropriate, offer an alternative or provide a refund for the unavailable product.
17. INTELLECTUAL PROPERTY
The MiLuxe Pantry name, branding, logos, original website content, graphics, text and other materials owned by us are protected by applicable intellectual-property laws.
You may use our website for personal, non-commercial shopping purposes.
You must not reproduce, distribute, commercially exploit or falsely represent MiLuxe Pantry's original branding or content without permission except where permitted by law.
Product images, manufacturer names, trademarks and other materials belonging to suppliers, manufacturers, Shopify or other third parties remain the property of their respective owners.
18. PRIVACY AND PERSONAL INFORMATION
We process personal information in accordance with applicable UK data-protection law and our separate Privacy Policy.
Personal information may be processed where necessary to:
• process orders and payments;
• arrange delivery;
• provide customer service;
• manage cancellations, returns and refunds;
• prevent fraud;
• comply with legal obligations; and
• operate and improve our online store.
To fulfil your order, relevant information may need to be shared with service providers such as Shopify, payment processors, DSers, suppliers, warehouses and delivery companies.
Where personal information is transferred internationally, appropriate safeguards will be used where required by applicable data-protection law.

19. THIRD-PARTY SERVICES
Our website may use or link to services provided by third parties, including Shopify, payment providers, fulfilment providers and delivery companies.
Third-party websites and services may have their own terms and privacy policies.
Nothing in this section excludes any responsibility that MiLuxe Pantry has to you under applicable UK consumer law for products sold by us.
20. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for:
• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; or
• statutory consumer rights that cannot legally be excluded or restricted.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.
We are not responsible for losses that were not reasonably foreseeable except where applicable law provides otherwise.
Products sold through MiLuxe Pantry are intended primarily for private and domestic use unless expressly stated otherwise.
21. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.
These may include serious transport disruption, carrier disruption, natural disasters, governmental restrictions or other events that could not reasonably have been prevented.
This provision does not remove any rights that consumers have under applicable law.

25. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections available to you under the laws applicable where you live.
Nothing in these Terms deprives you of mandatory consumer protections or rights concerning where legal proceedings may lawfully be brought.

These Terms are intended to work alongside, and not replace or reduce, your rights under applicable UK consumer law.
If any provision of these Terms conflicts with a mandatory statutory consumer right, your statutory rights will take priority.
